This Job Shadowing Agreement ("Agreement") is entered into by and between Shadow the Life ("Company" or "Website") and the student ("Student") participating in the job shadowing opportunity. By using the services provided by Shadow the Life, the Student agrees to the following terms and conditions:
Age Requirement: The Student must be 18 years of age or older to participate in job shadowing.
Assumption of Risk: The Student understands and acknowledges that participating in the job shadowing opportunity may involve certain inherent risks. The Student voluntarily assumes all risks associated with job shadowing and agrees that Shadow the Life shall not be held responsible for any injuries, damages, or losses that may occur during the job shadowing experience.
Liability Release: The Student agrees that Shadow the Life, its employees, agents, and representatives shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the job shadowing opportunity. The Student releases Shadow the Life from any liability for any injury, harm, or damages incurred during the job shadowing, regardless of fault.
Waiver of Lawsuit: The Student agrees that, to the fullest extent permitted by law, they shall not bring any lawsuit or legal claim against Shadow the Life or its employees, agents, representatives, or affiliates, arising from or related to the job shadowing. The Student hereby waives their right to initiate any legal action or claim against Shadow the Life.
Voluntary Participation: The Student acknowledges that participation in the job shadowing opportunity is voluntary and has been undertaken by their own choice. The Student is not under any obligation to participate and may choose to discontinue their participation at any time.
Safe and Respectful Conduct: The Student agrees to act in a safe and respectful manner during the job shadowing experience. They shall comply with all safety guidelines and instructions provided by the host company and will conduct themselves professionally and responsibly.
No Employment Relationship: The Student acknowledges and agrees that the job shadowing opportunity does not create or imply an employer-employee relationship between the Student and the host company. The Student understands that they will not be entitled to any employment benefits, including but not limited to wages, benefits, or workers' compensation.
Responsibility for Personal Belongings: The Student acknowledges and agrees that they are solely responsible for their personal belongings during the job shadowing experience. Shadow the Life, its employees, agents, or representatives shall not be held liable for any loss, damage, theft, or misplacement of the Student's personal belongings during the course of the job shadowing opportunity.The Student is encouraged to take necessary precautions to safeguard their personal belongings and is advised not to leave valuable items unattended. Shadow the Life shall not be responsible for reimbursing or replacing any lost, stolen, or damaged items.By participating in the job shadowing experience, the Student releases Shadow the Life from any claims or liabilities related to their personal belongings.
Modification of Agreement:Shadow the Life reserves the right to modify, update, or change this Agreement at any time without prior notice. Any such modifications will be effective immediately upon posting on the website. The Student's continued use of the job shadowing services after the posting of the modified Agreement constitutes their acceptance of the changes.
Right to Deny Participation:Host companies reserve the right to deny participation in the job shadowing opportunity to any Student at its sole discretion, without providing any reason for such denial.
Confidentiality Clause: The Student acknowledges that during the course of the job shadowing opportunity, they may have access to confidential or proprietary information belonging to the host company. The Student agrees to maintain the strictest confidentiality regarding any such information and not to disclose, reproduce, or use it for any purpose outside the scope of the job shadowing. This obligation of confidentiality shall continue even after the conclusion of the job shadowing experience.
Photography and Media Release: The Student grants Shadow the Life the irrevocable right and permission to photograph, film, or otherwise record their likeness, voice, and participation during the job shadowing experience. Shadow the Life is authorized to use and publish these materials for marketing, promotional, or educational purposes, including but not limited to website content, social media, brochures, and other marketing materials.The Student understands and agrees that they will not be entitled to any compensation, payment, royalties, or any other benefits from the use of these materials by Shadow the Life.
Severability: If any provision or part of this Agreement is held to be invalid, void, or unenforceable by a court of competent jurisdiction, such provision or part shall be modified to conform to applicable law or, if this would cause an illogical or unreasonable result, shall be stricken from the Agreement without affecting the binding force or effect of any other part or provision.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of laws principles.
Exclusive Jurisdiction: Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in Bexar County, Texas. The Student hereby consents to the exclusive jurisdiction of such courts.
Waiver of Jury Trial: The Student specifically waives the right to trial by jury in any legal proceeding arising from or related to this Agreement.
Modification of Agreement: Shadow the Life reserves the right to modify, amend, or update this agreement at any time without prior notice. Any changes to this agreement will be posted on this page, and the "Last Updated" date at the top of this page will reflect the date of the latest revisions. Users are encouraged to review this page regularly to stay informed about any changes. By continuing to use Shadow the Life after any modifications to this agreement, you acknowledge and agree to be bound by the revised terms.
By using Shadow the Life's website or participating in the job shadowing opportunity, the Student agrees to all the terms and conditions stated in this Agreement. The Student acknowledges that they have read and understood this Agreement and that it constitutes a binding legal contract between the Student and Shadow the Life.
